Labor Law

A Friend To Labor

From the very beginning of the firm, Frasier, Frasier & Hickman, LLP, has defended the rights of union members and workers. We are proud of our long association with the Oklahoma labor movement, and of our work for unions and individual union members.

Working For Oklahoma Unions

Working on behalf of Oklahoma unions, we represent members in union grievances and disputes in arbitration, and when necessary, in litigation. In the legislature, we work alongside Oklahoma unions to craft and achieve changes in workers’ compensation and other laws affecting workers in Oklahoma. Frasier, Frasier & Hickman, LLP, reviews lawyers’ labor union contracts and represents them in contract dispute matters.

Working For Union Members

As one of the nation’s top-rated law firms in the AFL-CIO’s Union-Plus Legal Services plan, we provide a wide array of personal legal services to union members and their families. In our active employment law practice, we fight to get justice for victims of racial and religious discrimination and to change employment policies and the work environment at Oklahoma for employers who engage in egregious behavior.

What role does a preexisting condition play in a personal injury claim?

A preexisting condition does not prevent you from seeking compensation, but it can complicate your case. The “eggshell plaintiff” rule means a defendant takes the plaintiff as they find them. If an accident aggravates or worsens your preexisting condition, you may be entitled to compensation for that additional harm. Key considerations include:

  • Disclosure: Be honest about preexisting conditions.
  • Causation: Prove the accident worsened your condition.
  • Compensation: Claim only for accident-related aggravation.
  • Documentation: Keep detailed medical records.

After all, you want to be a step forward in your case, not caught off guard by undisclosed information.

Can I file a personal injury claim against a government entity?

Yes, but special rules apply under the Oklahoma Governmental Tort Claims Act. Key points include:

  • File a written notice within one year
  • A 90-day waiting period before a lawsuit
  • 180-day period to sue if denied/ignored
  • $125,000 damage cap, with exceptions
  • Higher limits for larger municipalities

Some claims have different caps. As such, you need an experienced legal team to help you navigate these legal complexities effectively.
