{"id":46199,"date":"2019-05-02T00:00:00","date_gmt":"2019-05-02T05:00:00","guid":{"rendered":"https:\/\/3090326-fork.findlaw4.flsitebuilder.com\/blog\/2019\/05\/oklahoma-supreme-court-reverses-law-about-personal-injury-cases\/"},"modified":"2019-05-02T00:00:00","modified_gmt":"2019-05-02T05:00:00","slug":"oklahoma-supreme-court-reverses-law-about-personal-injury-cases","status":"publish","type":"post","link":"https:\/\/frasierlaw.com\/?p=46199","title":{"rendered":"Oklahoma Supreme Court reverses law about personal injury cases"},"content":{"rendered":"<p>An Oklahoma state law that limited damages for pain and suffering in a personal injury lawsuit has been rejected by the state&#8217;s Supreme Court.<\/p>\n<p>The justices ruled that a <a href=\"https:\/\/kfor.com\/2019\/04\/23\/oklahoma-supreme-court-invalidates-civil-justice-damages-cap\/\" target=\"_blank\">statute that limited noneconomic awards<\/a> to $350,000 was unconstitutional because it treated injured survivors, in terms of awards, differently from those who don&#8217;t survive.<\/p>\n<p>In the case considered by the state Supreme Court, an oilfield worker had to have his arm amputated after an accident in 2012 in which a boom fell from a crane and hit him. <a href=\"https:\/\/www.tulsaworld.com\/news\/state-and-regional\/oklahoma-supreme-court-nullifies-damages-cap-for-pain-and-suffering\/article_84629bb9-f3bb-544e-9fa7-b135b5a34825.html\" target=\"_blank\">The man was 34<\/a> at the time.<\/p>\n<p>A jury in Oklahoma County said the man and his wife were entitled to $6 million combined for pain and suffering, but the law forced it to be reduced to $350,000 each.<\/p>\n<p>The Supreme Court reversed the judge&#8217;s order to modify the jury award and referred the case back to district court. The judge there has been ordered to reinstate the jury&#8217;s award in full.<\/p>\n<p>The law requiring a cap in personal injury cases was adopted by the Legislature in 2011 and signed by former Gov. Mary Fallin.<\/p>\n<p>&#8220;The failing of the statute is that it purports to limit recovery for pain and suffering in cases where the plaintiff survives the injury-causing event, while persons who die from the injury-causing event face no such limitation,&#8221; the justices wrote in their order.<\/p>\n<p>Through no fault of his own, this man suffered a significant, life-changing injury that will affect him the rest of his life, which the jury recognized.
